The overview of the maritime case law in Hong Kong 2011

Abstract

2011年香港海商法判例,來自香港高等法院原訴法庭和上訴法庭。案件主要涉及海上貨物運輸責任限額、海運單的法律適用、建造中船舶的所有權、管轄地的選擇、船舶碰撞責任等法律問題。這些案件既有實體法律問題,也有程序法律問題,涉及多國法律的選擇和管轄地法院的選擇,充分體現了海商案件的復雜性和多元性。 The maritime cases of Hong Kong in 2011 include judgments from the Court of First Instance and the Court of Appeal in the High Court of the HKSAR.The cases mainly involve issues of liability limit in carriage of goods by sea,the applicable law under sea waybills,property of ship under construction,choice of jurisdiction and liability of collision.These cases concern both substantial law and procedure law relating to multiple national laws and choice of eligible court in different jurisdictions.This embodies the complex and pluralism of maritime cases.
